2년 전, 지혜복 교사는 학교 내 성폭력 문제를 고발했다는 이유로 부당하게 강제전보, 해임당했다. 그리고 1월 29일, 법원은 지혜복이 공익제보자이며 이 전보가 부당하다고 판결해 지혜복 교사의 주장이 옳았음을 입증했다. 이는 지혜복 선생님의 2년간의 끈질긴 의지, 그리고 평등하고 안전한 학교와 사회를 갈망하는 사람들의 연대가 만들어낸 승리다.

2년 전, 지혜복 교사는 학교 내 성폭력 문제를 고발했다는 이유로 부당하게 강제전보, 해임당했다. 남학생들은 수년간 구조적으로 여학생들을 성추행하고 괴롭혀 왔으며, 지혜복 교사는 학생들의 증언을 통해 이를 알게 되었다. 지혜복 교사는 피해자를 보호하고 포괄적 성교육 관점에서 문제를 해결하려 했지만, 학교는 가해자를 제대로 징계하려 하지 않았다. 더 심각한 것은 성폭력을 신고한 피해자들의 신원이 노출되었음에도 학교가 피해자를 보호하기 위한 어떠한 조치도 취하지 않아 2차 피해를 입게 했다는 점이다. 그래서 지혜복 교사는 이 사건을 공익신고하고 피해자들을 위해 싸웠으며, 마침내 2년, 740일 간의 투쟁 끝에 1월 29일 법원이 지혜복은 공익제보자가 맞으며 전보는 부당하다고 판결했다.

 

이 2년간의 'A학교 투쟁'은 한 교사만을 위한 투쟁이 아니었다. 피해자들의 완전한 회복을 위한 투쟁이었고, 성폭력 피해자들에게 침묵을 강요하는 사회를 바꾸기 위한 투쟁이었다. 그리고 이는 지혜복 교사 혼자만의 싸움이 아니라, 안전하고 평등한 사회를 위해 투쟁하는 모든 노동자, 학생, 여성, 소수자들의 투쟁이었다. 그래서 지혜복 교사는 혼자가 아니었고, 법원의 판결은 뜨거운 연대가 만들어낸 결과였다.

 

지혜복 교사가 투쟁하는 동안, 소위 '진보 교육감'이라는 서울시교육감 조희연과 정근식은 아무것도 하지 않았다. 오히려 지혜복이 공익제보자임을 부정하고, 지혜복 교사를 부당전보·해임했으며, 심지어 형사 고발까지 했다. 이는 소위 '진보적'이라는 서울시교육감들이 책임자들을 처벌하지 못했을 뿐만 아니라, 오히려 그들을 부추겨 학교를 안전하지 않고 불평등한 곳으로 만들었음을 보여준다. 그리고 지혜복 교사가 소속된 전교조조차 투쟁을 외면한 사실은 그들의 관료주의를 적나라하게 드러낸다.

 

조희연과 정근식 전-현 서울시교육감은 피해자와 지혜복 교사에게 공개적으로 사과해야 한다. 그리고 피해자들의 완전한 회복을 지원하고, 서울 모든 학교에서 성폭력 문제에 대한 전면 조사를 실시하며, 포괄적 성교육을 도입해야 한다. 또한 지혜복 교사를 즉시 본래 직위로 복직시켜야 한다.

 

지혜복 교사, 그리고 지혜복과 연대하는 우리는 모두 함께 더 안전하고 평등한 학교와 사회를 위해 더 큰 투쟁을 해나갈 것이다.

2 years ago, Ji hye-bok, a teacher was unjustly and forcibly transferred to another school, for the reason that she whistle-blowed the sexual violence problem in her school. and on 29th January, the court ruled that the transfer was unjust, proving that Ji Hyebok was right. this is victory made by 2 years of passionate and long-standing will of Ji hyebok, and by solidarity of the people aspiring to equal and safe school and society.

2 years ago, Ji hye-bok, a teacher was unjustly and forcibly transferred to another school, for the reason that she whistle-blowed the sexual violence problem in her school. the male students systematically continued to sexually harass and bully female students for years, and Ji hyebok got to know that from the testimonies of the students. she tried to protect the victims and tried to solve the problem with comprehensive educational perspective, but the school doesn’t want to displine the perpetrator properly, and more seriously, the identities of the victims that reported the sexual violence were exposed, but the school didn’t do anything to protect the victims, exposing them to the secondary harming. that’s why Ji Hyebok whistleblowed this case and fought for the victims, and finally after 2 years, 740 days of the struggle, the court ruled today that the transfer of ji Hyebok was unjust.

 

for these 2 years, this ‘A school struggle’ has not been just a struggle of one teacher. it was a fight for the full recovery of the victims, and to change a society that forces silence to the victims of sexual violence. and it was a fight not only by ji hyebok, but by all workers, students, women, and minors who struggled for safe and equal society. that’s why ji hyebok wans’t alone, and the court’s decision was the result of passionate solidarity.

 

While Teacher Ji Hye-bok was fighting, Cho Hee-yeon and Jeong Geun-sik, the so-called ‘progressive chairman of Seoul educational office’ did nothing for her. rather, they denied that ji hyebok is whistleblower, and they forcibly transferred her, fired her, and even filed criminal charges against her. this shows that these so-called ‘progressive chairmen of seoul educational office, not only failed to punish those responsible, but actually encouraged them, making the school unsafe and unequal. and the fact that even the labor union where ji hyebok belong, turned a blind eye to her struggle, starkly reveals their bureaucracy.

 

the chairman of Seoul educational office, must publicly apologize to the victims, and Teacher Ji Hye-bok. they must support the victims' full recovery, and conduct a comprehensive investigation on sexual violence problems, and introduce comprehensive sex education in all schools in Seoul. and, immediately reinstate Ji Hye-bok to her original position.

 

Teacher Ji Hye-bok, and our comrades in solidarity with her, all together will march toward a greater struggle for safer and more equal schools and society. March to Socialism also will be always at that fight. 투쟁!
